1. Defendant A shall be punished by imprisonment with prison labor for ten months;

However, the execution of the above punishment for two years from the date this judgment becomes final and conclusive.

Reasons

Punishment of the crime

[2016 Highest 741] Defendant A is a person who has worked as a business member of the planned real estate in Busan Highest 13th century, and Defendant B was a representative director of the Dispute Settlement Council.

On October 22, 2010, the Defendants entered into a sales contract with L to KRW 16,244 square meters of forest land in Nam-gu, Nam-gu, Sinpo-si.

The Defendants divided the above forest land in spite of the fact that the above forest was a natural green area, and that there was no planned development as a national industrial complex, and sold the said forest land by deceiving the buyers, who are likely to make profits from market prices by developing the said forest as a national industrial complex, to acquire profits therefrom.

On November 2010, the Defendants, at the Seocho-gu Office of the Dispute Settlement Council, sell the victim M in lots from November 3, 201 to 500 square meters. The Defendants are developing into an industrial complex from 200 to 200,000 square meters. The Defendants may receive 70,000 won per square year, even if they were not developed after 2 years. The Defendants may sell within 700,000 won per square year. The Defendants may sell within 700,000 won per square year. The Defendants, as the purchase price for the “n 661,000,000,000 won of the Nam-gu N. 661 square meters of the land at port” from the victims. The Defendants, as the sum of the purchase price for the “n Don Don Gyeong-gu, 200,000 won of Nov. 3, 2010, 200 J. 408.

[2016 Highest 3044] Defendant B was the representative director of the planning real estate in Busan High-gu, Busan High-gu, and Defendant C was working as a member of the dispute resolution council.

On October 22, 2010, the Defendants concluded a sales contract to purchase L of 16,244 square meters of forest land and the above forest land as purchase price of KRW 198 million (40,000 per square year) with the owner of “Y in Nam-gu, Nam-gu, Sinpo-si,” and KRW 198 million of forest land.

The defendants are not likely to develop the forest as a natural green area, because the above forest has one mountain between the O industrial complex of the port and the general industrial complex of the port P.
