1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

Reasons

1. On June 201, the Plaintiff, B, and C (hereinafter “Plaintiff, etc.”) entered into a service contract with the Defendant on the condition that, in order to enable the Defendant to carry out the new construction of officetels on the land including Mapo-gu Seoul Metropolitan Government land (hereinafter collectively referred to as “instant project site”), the Plaintiff, etc. entered into a sales contract with the Defendant as the purchaser for the said land and its ground building (hereinafter “instant service contract”). The main contents are as follows.

Article 1 (Purpose of Service Contract) A refers to Defendant, Plaintiff, etc.

In order to secure the business site of the above, A shall pay the service cost to B for the purchase of the above object, and upon request for the purchase of the object, A shall promptly and efficiently achieve the above purchase of the object.

Article 2 (Contents of Services) B shall be the conclusion of a contract under the name of Party A for the sale and purchase of the above-mentioned objects (including ground buildings and obstacles) and incidental affairs thereto, with an average purchase price of the above-mentioned land, which shall not exceed 31.6 million won per square meter.

Article 4 (Scope of Business)

1. The scope of business of Eul shall be as follows:

1) On the basis of the sales price determined by Party A, the seller of the object (land and ground owner) and Party A’s sales contract between Party A and Party A (2) The survey of the current status of the land for the three purchased items, the analysis of rights, the survey and analysis of the site conditions, the review of proper purchase price, the consultation on efficient land use, and the congested support for development direction.
