The prosecution of this case is dismissed.
1. On January 23, 2018, the Defendant, at around 10:30 on January 23, 2018, insultingly insulting the victim by openly insulting the victim, following the Defendant’s view that “A” on the first floor of the building B, i.e., “C”, and other customers or employees of the said spione room, are heard by other customers or employees of the said spione,” with a large voice of the victim.
2. The judgment is a crime falling under Article 311 of the Criminal Act and can be prosecuted only upon a victim’s complaint pursuant to Article 312(1) of the same Act. Since the victim revoked the Defendant’s complaint on August 29, 2018, which was after the instant indictment, the prosecution of this case is dismissed in accordance with Article 327 subparag. 5 of the Criminal Procedure Act.
