The action for retrial shall be dismissed.
The litigation costs for retrial shall be borne by the plaintiff.
Reasons
According to the records, even though the plaintiff (the plaintiff) repeatedly filed a lawsuit for retrial and has been repeatedly dismissed or dismissed, the plaintiff (the plaintiff) filed a lawsuit for retrial to the same purport. Such lawsuit is unlawful as it constitutes an abuse of the right of lawsuit for retrial.
Therefore, the retrial suit of this case is dismissed, and the costs of the retrial are assessed against the losing party. It is so decided as per Disposition by the assent of all participating Justices on the bench.
