The defendant shall pay 67,208,703 won to the applicant for compensation by deceit.

[Criminal Power] On November 9, 2012, the Defendant was sentenced to imprisonment with prison labor and two years and six months at Seoul High Court on November 9, 2012, and the said judgment became final and conclusive on the 17th of the same month.

【Criminal Facts】

1.(a)

The defendant did not have any specific income other than 1.2 million won as a monthly income, and there was no specific property in the name of the defendant, and because he was unable to pay 10 million won personal debts, he was under the circumstances of bad credit standing from the beginning of 2006, he did not have any intention or ability to complete payment even if he borrowed money from others.

Nevertheless, on March 26, 2007, the Defendant made a false statement to the victim C, stating, “If a bridge is to go to Ampha Hospital because there is no hospital expenses, it will write KRW 1,000,000, and repaid monthly pay in the following month.”

The Defendant, by deceiving the victim, received the victim’s Samsung Card (F) from the victim on the same place, and purchased goods, etc. in the aggregate amounting to KRW 12,845,439 on 107 occasions from March 27, 2007 to January 2, 2008, and approved it by the said credit card.

In addition, the Defendant, from March 27, 2007 to January 17, 2008, by deceiving the victim in the same manner as shown in the attached list of crimes (2) and received seven copies of the credit card issued by the victim, and then purchased goods, etc. in the aggregate of 66,212,703 won through 538 times, and approved the purchase by the credit card.

There was no intention or ability to repay money to others even if they borrow money from others due to economic difficulties such as the statement in this paragraph.

Nevertheless, on September 15, 2007, the Defendant made a false statement to the victim C, stating, “I will immediately receive monthly rent deposit of KRW 1,000,000 from his father if I want to do so. I want to pay the monthly rent of KRW 1,00,000.”

The defendant deceivings the victim as such, and is in his position against the victim.
