The lower court rejected Defendant’s assertion as to Defendant’s mental and physical disorder on the grounds as indicated in its reasoning.

The judgment below

In light of the records, there is no error of misapprehending the legal principles as to mental disorder as alleged in the grounds of appeal.

In addition, the argument that there is an error of mistake or misapprehension of legal principles in the judgment of the court below is not a legitimate ground for appeal, which is alleged in the ground for appeal by the defendant as the ground for appeal or not subject to judgment ex officio.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
