The costs of appeal are assessed against the Plaintiff.

In light of the records, the court below is just to determine that the evidence submitted by the plaintiff alone is not sufficient to conclude that the plaintiff actually lent KRW 300 million to the defendant. Contrary to the allegations in the grounds of appeal, the court below did not err by exceeding the bounds of the principle of free evaluation of evidence against logical and empirical rules, or by failing to exhaust all necessary deliberations, which affected the conclusion of the judgment. The court below did not err by misapprehending the legal principles as to the disposition right principle

Therefore, the appeal is dismissed, and the costs of appeal are assessed against the losing party. It is so decided as per Disposition by the assent of all participating Justices on the bench.
