A defendant shall be punished by imprisonment for not less than one year and six months.
Punishment of the crime
On June 19, 2014, the Defendant was sentenced to imprisonment with prison labor for the crime of forging official documents at the Seoul Central District Court, etc. and the said judgment became final and conclusive on August 29, 2014.
In collusion with B, the Defendant: (a) conspired with B, the Defendant: (b) performed D 108,879m2, a forest land owner in Chungcheongnam-si; and (c) B concluded a sales contract for the said real estate after finding the purchaser of the said real estate; and (b) intended to acquire the down payment amount by fraud.
In accordance with the above public offering, B concluded that “B may sell and purchase the 108,879m2 at a price lower than the market price of 108,879m2 to the victim F through E on November 201, 201.” In this context, B concluded a sales contract only with the seller in Seoul.
1. On November 30, 201, the Defendant: (a) heard the aforementioned proposal at the instant coffee shop near Songpa-gu Seoul Metropolitan Government Songpa-gu, Songpa-gu, Seoul; (b) presented D’s resident registration certificate and certificate of seal impression; (c) was the owner of the said real estate; and (d) sold the said real estate at KRW 2 billion.
Then, B entered the indication column of the real estate in the real estate sale contract with the purpose of exercising the right without the consent of D, in the column of indication of the real estate in the real estate sale contract with the purpose of using the penture, “CY 108,879 square meters”, “The purchase price amount of KRW 100,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,00,000
D’s seal was affixed.
Accordingly, the Defendant, in collusion with B, forged one copy of the real estate transaction agreement in the name of D, which is a private document on rights and obligations, and, in other words, delivered the forged real estate transaction agreement in the name of D to F as if it was genuine.
