1. The Defendant’s KRW 35,00,000 for the Plaintiff and KRW 15% per annum from December 30, 2018 to May 31, 2019 for the Plaintiff.
1. On November 3, 2008, the Plaintiff lent 35 million won to C with marriage expenses. Since the above C died on December 3, 2008, the Plaintiff sought payment of the above loan against the Defendant who is the heir as C’s spouse.
2. Article 208 (3) 3 of the Civil Procedure Act (Judgment by public notice) of the applicable provisions of Acts;
3. On the ground of partial dismissal of claims, only damages for delay calculated by the rate of 12% per annum from June 1, 2019, following the enforcement of the provisions on statutory interest rate under the main sentence of Article 3(1) of the Act on Special Cases Concerning Expedition, etc. of Legal Proceedings (Presidential Decree No. 29768) amended on May 21, 2019.
