The Defendant’s disposition of disability ratings (out of time disability ratings) rendered to the Plaintiff on March 13, 2018 shall be revoked.
The costs of lawsuit.
1. Details of the disposition;
A. On December 27, 2017, the Plaintiff received the examination of the maximum correction time 0.02 and class 6 of class 0.6 of the unit 0.6 at B hospital, and filed an application for registration of disabled persons with the Defendant on December 28, 2017.
On the basis of disability ratings, visual disability will be determined by judging whether it is appropriate to reduce the eyesight by performing a bronology test, a bronology test, and a cronology test, if there is a significant fall in eyesight compared to an objective visual condition.
The eyesight disorder shall meet the minimum standard for disability ratings if the eyesight of a bad eye is not more than 0.02 (Grade VI) or the eyesight of a good eye is not more than 0.2 (Grade V).
- The eyesight of the right eye on the letter of disability diagnosis is written 0.02, but considering the fact that the eyesight in the letter of disability examination was measured 0.04 on August 2017 and the progress of treatment in the letter of disability examination, it is not recognized that the degree of vision of the right eye falls under the minimum grade of visual disability in the standard of disability rating.
Accordingly, I shall be judged aside from the grade.
B. On January 29, 2018, the Defendant notified the National Pension Service of the following results upon requesting a close examination of the Plaintiff’s visual disability degree, and notified the Plaintiff of the determination of the disability grade “out of the class” to the Plaintiff.
I have raised an objection to the determination other than the visual disability grade for the reasons for objection.
The standard visual disability of grading shall be based on the maximum corrected eyesight measured by all kinds of visual devices, including eye and contact lensess, and if there is a remarkable fall in eyesight compared to the objective visual condition, the test, etc. shall be conducted to determine the visual disability after determining whether it is appropriate to reduce the eyesight.
The 6th grade of visual disability (minimum grade standards) shall be 0.02 or less if the eyesight of the eye is bad.
