[2015 Highest 2103] From September 15, 2014 to September 17, 2014, Defendant A: (a) installed 20 Gara’s game machine 20 and 100 Gara’s game machine 100, which was operated by the said Defendant, in the mutual game place, “F Gameland,” which was operated by the said Defendant on the third floor of Daejeon U.S. E; and (b) exchanged customers with the amount obtained by deducting 10% of the points obtained as a result of the game by the Game Management Committee on the 120th unit for the said game machine, for their use by providing them to customers; and (c) exchanged customers in cash the amount obtained by deducting 10% of the points obtained by the said Defendant.

As a result, Defendant A provided unclassified game products to many unspecified customers and exchanged tangible and intangible results obtained through the use of game products, and operated speculative acts using speculative gaming machines.

1. Defendant A

A. From September 20, 2014 to November 20, 2014, the Defendant established a 75 game machine, such as “H game room” (the second floor above the ground), a total user of the game work, and exchanged the amount calculated by deducting 10% from the points obtained by customers as a result of their games.

As a result, the defendant provided game products not classified for use, and exchanged tangible and intangible results obtained through the use of game products, and operated speculative acts using speculative gaming machines as a business.

B. From January 16, 2015 to January 31, 2015, the Defendant installed at “J Gameland” in “J Gameland,” and installed 60 game equipment, which is a game product used as a whole, and installed the game machine, and installed the radio communication camera (one call device) on each of the above game machine, thereby raising a lot of points on the part of the Defendant.
