Defendants shall be punished by imprisonment for four months.
However, with respect to the defendant B, it shall be for two years from the date this judgment becomes final and conclusive.
Punishment of the crime
1. The Defendants’ co-principal (acquisition of stolen goods) together with D, E, and F, Defendant B sent 30-50,000 won each day to Defendant A purchase stolen mobile phones, and Defendant A divided them into D, etc., and Defendant A purchased stolen mobile phones from taxi drivers, etc., which are the stolen goods lost by taxi drivers, from taxi drivers, etc., and delivered them to Defendant B. Defendant B made part of the amount of money disposed of to Defendant A as profits, and Defendant A conspired to distribute them together with D, etc.
From December 20, 2013 to January 2014, 2014, the Defendants: (a) purchased 9 parts of the total number of 2,470,000 taxi cell phones in the name of taxi customers in the vicinity of Yanyang-dong in Gwangjin-gu; (b) the vicinity of the Yanyang-dong in Gwangjin-gu; and (c) D et al. in the vicinity of the Yanyang-dong in Dongdaemun-gu, Dongdaemun-gu, the market price and 9 parts of the mobile phone from the 2,470,000 won.
In addition, from around that time to January 23, 2014, the Defendants acquired a total of KRW 176,766,000 of the total purchase price in 13 times, such as the list of crimes in the attached list of crimes, from around that time to January 23, 2014.
Accordingly, the Defendants acquired stolen goods in collusion with D, etc.
2. The sole criminal conduct of Defendant A;
A. At around 22:00 on January 22, 2014, the Defendant driven a vehicle from Seongbuk-gu Seoul Easternernern to January 23, 2014 without obtaining a driver’s license on a section of about 50 meters from the road near Dongdaemun-gu Seoul, Dongdaemun-gu to January 23, 2014.
B. The Defendant causing property damage, around January 23, 2014, driven by a police officer on the front and rear side of Dongdaemun-gu Seoul, Dongdaemun-gu, Seoul, to arrest the Defendant.
