1. As to KRW 44,229,634 and KRW 42,00,00 among them, the Defendant shall annually pay to the Plaintiff KRW 44,229,634 from December 31, 2018 to January 24, 2019.
On August 28, 2014, the Plaintiff loaned KRW 46,00,00 to the Defendant on August 28, 2018, with a rate of 9.85% per annum on the day when the loan expires, and the Defendant lost the benefit of time due to the Defendant’s failure to pay the principal and interest of the obligation. On December 30, 2018, the unpaid principal and interest of the loan amount amount of KRW 42,00,000, not paid interest and interest interest amount of KRW 2,229,634 may be recognized by adding the entire purport of the pleadings to each of the statements in evidence No. 1, 2, and 3.
Therefore, the Defendant is obligated to pay the Plaintiff damages for delay calculated by applying the rate of delay interest rate of 9.85% per annum from December 31, 2018 to January 24, 2019, the delivery date of the original copy of the instant payment order, and the rate of 15% per annum from the following day to the date of full payment.
Thus, the plaintiff's claim of this case is accepted on the ground of the reasons.
