A defendant shall be punished by imprisonment for four months.
However, the execution of the above sentence shall be suspended for a period of one year from the date this judgment becomes final and conclusive.
Punishment of the crime
No person of "2018 Highest 976" shall distribute, sell, lease, or openly exhibit obscene codes, language, sound, images, or motion pictures through an information and communications network.
Nevertheless, around 04:24 on February 17, 2018, the Defendant, at his own house located in Changwon-si, a member of Changwon-si, by using a computer, connected to the Internet web website “D” website using the Defendant’s ID, and posted a notice to enable many unspecified persons to download by downloading a video file containing a scopical sexual act between men and women, as the title “E” on the adult bulletin board, and in addition, from around 16:15 on June 26, 2017 to July 18:15, 2018, the Defendant included a video file in the above D website and “F” website through the aforesaid method in the crime list (A-D) No. 1 to 380 on a year and the list of crimes (AF-5) and the list of crimes (AF-5 on a day-day).
Accordingly, the Defendant distributed obscene images through information and communications networks.
No person of "2018 Highest 1124" shall distribute, sell, lease, or openly exhibit obscene codes, language, sound, images, or motion pictures through an information and communications network.
Nevertheless, around June 11, 2018, the Defendant, at the Defendant’s residence located in Changwon-si Member C of Changwon-si, connected the Internet file sharing site using the Defendant’s ID to “G”, which is an Internet file sharing site, and posted a video file, which contains a dysical act of sexual intercourse between men and women, as the title “H” on the adult bulletin board, in order to have it download to an unspecified number of people.
Accordingly, the Defendant distributed obscene images through information and communications networks.
