1. Facts of recognition;
A. On January 4, 2005, the Plaintiff entrusted the forestry cooperative in the forest cooperative in the forest room B and C owned by the Plaintiff (hereinafter “D forest”), and each forest in the forest room E, F, and G located in the former North Korea (hereinafter “H forest”; hereinafter “D forest”) with the management of the instant forest by proxy from January 4, 2005 to January 3, 2015.
B. The Defendant entrusted the forest cooperative of the relevant Si/Gun to perform the forest tending project for D forest from September 26, 2008 to October 6, 2008; from September 24, 2010 to October 19, 2010; and from September 24, 2010 to October 24, 2010, the forest tending project is performed. The forest tending project means growing forests by performing works such as piling up, growing trees, cutting down, natural forests, etc. with respect to artificial afforestation land or natural forests, and the procedure is to be conducted in the order of project completion in order of the project completion decision-making design to determine whether the forest is subject to the project.
C. The Plaintiff prepared and provided the written consent for the forest tending project (hereinafter “instant written consent”) to the Defendant, and the instant written consent states that “The area of the project may be increased or decreased in accordance with the provisions in performing on-site investigation and design procedures, and where it is impracticable to implement the project within the budget of the pertinent year, the project may be implemented in the following year.”
Trees cut in H forest land recorded in the report on the volume of deforestation of the forest tending project is 961 weeks, 536 weeks, and 2,052 other trees. Trees cut in D forest land are 66 weeks, 66 weeks, 66 weeks, and 2,136 weeks, and the sum of trees cut in the instant forest land is 961 weeks, 602 weeks, 66 weeks, and 4188 weeks, all of which are the sum of trees cut in D forest land.
