1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

Reasons

1. Basic facts

A. On May 8, 1996, the Plaintiff joined the Defendant and thereby engine BG (BG).

(2) On January 16, 2008, the Defendant, from C (State) established in 1976, has changed the name of the company as of April 2005, and is engaged in manufacturing, sales, etc. using 4,500 full-time workers at the above location, such as diesel engines, construction-time equipment, and forking vehicles.

B. On January 208, 2008, the act of theft of parts by a driving engineer D of an outsourcing company in charge of transporting parts in collusion with E of the Defendant’s material management team at the Defendant’s Incheon factory was discovered. The Defendant’s act of preparing a false supply document in collusion with the Defendant’s material management team and receiving payment in excess of the actual supply quantity was discovered around October 2008, and was subject to criminal punishment for the relevant parties. 2) The Defendant formulated a plan to conduct an audit of entire BG material management from February 2009 to June 30, 2009, and conducted an audit of the unit BG materials-related departments (materials management team, production management team, research and development team, and production team) from February 20, 2009 to June 30, 2009, the Plaintiff, including the Plaintiff, was 12 employees, including the Plaintiff, to whom one of the recommendation was made.

3 The defendant demanded that the plaintiff be subject to recommendation from May 2009, but the plaintiff did not comply with it.

Since then, the plaintiff submitted a resignation statement on August 2009, and then withdrawn the resignation statement during the same month and submitted a written request for deliberation by the personnel committee to the management.

The defendant rejected the plaintiff's written resignation and then referred the plaintiff to the personnel committee due to the following grounds for disciplinary action.
