피고인은 2016. 1. 22. 23:38 경 혈 중 알콜 농도 0.135% 의 술에 취한 상태에서 B 싼 타 페 승용차를 운전하여 인천 남동구 남촌에 있는 제 2 경인 고속도로 인천항방향 7.4km 앞 도로 1 차로를 따라 안양 방면에서 인천 방면으로 진행함에 있어, 위와 같이 술에 취해 정상적인 운전이 곤란한 상태에서 전방을 제대로 주시하지 아니하고 조향장치 및 제동장치를 부정확하게 조작한 업무상 과실로, 위 싼 타 페 승용차의 앞 범퍼 왼쪽 부분으로 위 도로 중앙 분리대를 들이받아 그 방현 막이 반대편으로 튕겨 나가게 함으로써 반대 차로에서 진행하고 있던 피해자 C(23 세) 이 운전하는 D 액센트 승용차의 앞부분이 위 방현 막에 들이받게 하여 위 C에게 약 2 주간의 치료를 요하는 요추의 염좌 및 긴장 등의 상해를, 위 액센트 승용차에 동승하고 있던 피해자 E(23 세 )에게 약 2 주간의 치료를 요하는 요추의 염좌 및 긴장 등의 상해를 각 입게 하였다.
