A shall be punished by a fine of KRW 7 million, and Defendant B shall be punished by a fine of KRW 10 million.

The above fines are imposed by the Defendants.

1. Defendant B is a person who is engaged in driving a car in C SPP site.

On May 6, 2020, the Defendant, without obtaining a driver's license of a motor vehicle around 08:20 on May 6, 2020, was under the influence of alcohol level of 0.169% in the blood alcohol level, and the front side of the E elementary school in Incheon Bupyeong-gu D was under the influence of alcohol level of 0.169% in G from the F bank.

Since there is a distance within the children's protection zone where signal lights and crosswalks are installed, the driver of the vehicle has a duty of care to reduce the speed and to operate the steering gear and brakes accurately.

Nevertheless, under the influence of alcohol, the Defendant was placed in the front part of the Defendant’s vehicle with pedestrian signal, etc. installed in India, without operating the steering gear and brakes properly.

Ultimately, the Defendant, without a driver’s license, driven a motor vehicle while under the influence of 0.169% alcohol during blood, and damaged the foregoing pedestrian signal, etc. by negligence in the course of performing his/her duties to amount to KRW 980,00,000.

2. Defendant A

A. The Defendant, at the time and place specified in paragraph (1) of this Article, was aware of the fact that he was trying to drive alcohol in a drunken state with the above B at the time and place, thereby facilitating the commission of the crime by getting on the top of the car driven by B and giving guidance to B.

Accordingly, the defendant could easily commit the crime of drinking alcohol in B.

B. The Defendant: (a) was aware at the time stated in paragraph (1) that B was actually driving the said vehicle at the scene of the accident; (b) but, in order to conceal the crime, such as drinking driving, etc. in B, he/she driven the said vehicle to H of the Samsan Police Station and its security guards.
