A shall be punished by a fine for negligence of KRW 3,000,000, and by a fine of KRW 2,000,000.

The above fine is imposed against the Defendants.

Defendant

A is the chairperson of the D Organization (hereinafter referred to as the "D Organization"), and the defendant B is the chairperson of the D Organization's University Education Committee.

Nevertheless, the Defendants decided to distribute incentives to prevent the election of F candidates and to hold the “G” assembly on December 1, 2012 in order to determine that the 18th presidential election, carried out on December 19, 2012 as well as the executive officers of D Organizations with D Organizations’ names, is a candidate who has no intention to realize the so-called “anti-value registration fee” in relation to the 18 presidential election carried out on December 19, 201.

1. From 15:50 on December 1, 2012 to 16:30 on the same day, the Defendants distributed 200 copies of printed matter under the law to an unspecified number of citizens, who passed away from 15:50 on December 1, 2012, which read “F candidates for a fake presidential candidate who only speaks of anti-registration money, such as the draft and refusal of anti-value registration money,” prior to holding a “G” assembly, the Defendants distributed 200 copies of printed matter under the title “the President who carried out anti-value registration money,” which read “the half-value registration money,” to the effect that the university students belonging to D organizations in front of the withdrawal and the 4th terminal station located in Jongno-gu Seoul Metropolitan Government.

As a result, the defendants in collusion with university students belonging to D organizations in the name of a political party or the name of a political party or candidate for the purpose of influencing the election from 180 days before the election day to the election day.
