1. Basic facts
A. The Plaintiff and the Defendant completed the marriage report on March 19, 1985, and completed the marriage report on December 9, 1985, and had a birth of her husband and wife and liveded on September 29, 2008. < Amended by Act No. 874, Sep. 29, 2008>
B. At the time, the Defendant owned the real estate listed in the separate sheet (hereinafter “instant real estate”). 2. Both claims;
A. The Plaintiff’s assertion 1) The Plaintiff and the Defendant, upon a divorce between the Plaintiff and the Defendant, assessed and disposed of the market price of the instant real estate owned by the Defendant to the extent of KRW 300,000,000, and decided that the Plaintiff would have paid KRW 100,000 to the Defendant, but the Plaintiff agreed to manage the instant real estate until the disposal was made. At that time, the Plaintiff already paid KRW 25,00,000 to the Defendant. However, since the instant real estate was not disposed of and is registered as owned by the Defendant, the Defendant is obligated to pay the Plaintiff the remainder of KRW 75,00,000,000, out of the agreed amount, and at the same time, to implement the registration procedure for transfer of ownership of the instant real estate. 2) The details of the property division agreement that had been concluded between the Plaintiff and the Defendant with respect to the instant preliminary real estate claim, until the Plaintiff disposed of the instant real estate, and the purchase price thereafter is the original Defendant.
