[Defendant A] The defendant shall be punished by imprisonment for one year.
However, the above sentence shall be executed for two years from the date this judgment becomes final and conclusive.
Punishment of the crime
1. Defendant A
(a) Where a transferee of an automobile violating the Automobile Management Act intends to transfer it to a third party, he shall make a registration of transfer of ownership in his name to the Mayor/Do governor;
1) On December 1, 2012, the Defendant: (a) acquired the INAS car from H on the street in front of the GG building in Busan Metropolitan City, and did not transfer the said car under the name of the Defendant; (b) transferred the said car to K on the street in front of the Jtel in Busan Metropolitan City on December 3, 2012; and (c) on April 18, 2013, around 21:30, the Defendant transferred the said car to K on the street in front of the National Bank located in the Busan Metropolitan City, Seosan-dong, Busan Metropolitan City on April 18, 2013; and (d) transferred the said car under the name of the Defendant without transferring the said car from H on May 19, 2013 to B and D on the street in front of the Busan Metropolitan Building in Busan Metropolitan City on May 3, 2013.
B. The Defendant purchased a one-time substitute vehicle as described in paragraph (1), and subsequently, conspired with a person who has no name nor forged documents related to the registration of transfer to the foregoing substitute vehicle with intent to forge the documents for the registration of transfer, and then transfer the same to another person.
1) On December 2012, 2012, the Defendant: (a) requested the document fabrication business entity to forge the NN’s personal seal impression under the name of the title holder of the INASA car; (b) on the “N”, “N”, “O of Gyeonggi-do Suwon-si,” and “N’s personal seal stamp in the name column,” the Defendant stamped the name of the head of Suwon-si, Suwon-si, Gyeonggi-do, where he was kept in custody.
Accordingly, the defendant forged a certificate of personal seal impression of N in the name of the head of Dong in Suwon-si, Gyeonggi-do, which is an official document, for the purpose of exercising in collusion with the person who is not registered.
B. On December 3, 2012, around 17:30 on December 3, 2012, the Defendant is in front of Busan Jtel-gu Busan.
