Reasons

1. Basic facts

A. On September 6, 1982, Defendant Samsung-si purchased D large 91 square meters and completed the registration of ownership transfer on September 10, 1982, and constructed a new building of a size of 164.26 square meters on the ground and used it as E-dong office around September 14, 1998. As E-dong office was integrated into F-dong office around November 14, 1998, the above land and buildings were leased to H branch of G trade union from July 1997 to December 31, 2013.

On the other hand, on June 17, 2013, the said land was converted from the administrative property to the general property on the ground of the disuse, and was divided into D large scale 837 square meters on January 20, 2014, I large scale 107 square meters, and land No. 1 in this case.

B. As to the land No. 2 of this case, the same month as May 4, 1971

4. The registration of transfer of ownership in the name of the JJ as of March 15, 1986, and the registration of transfer of ownership in the name of the defendant Han-dong Federation, a defendant incorporated as the defendant, was completed on the ground of donation on March 14, 1986;

다. 이 사건 제1 토지 중 별지 도면 표시 25, 26, 27, 28, 25의 각 점을 차례로 연결한 선내 ㈄ 부분 17㎡와 이 사건 제2 토지 중 별지 도면 25, 28, 27, 29, 30, 31, 32, 33, 34, 35, 25의 각 점을 차례로 연결한 선내 ㈀ 부분 90㎡ 지상에는 원고 소유의 주택이 건축되어 있고, 이 사건 제2 토지 중 별지 도면 표시 36, 37, 38, 39, 40, 41, 36의 각 점을 차례로 연결한 선내 ㈂ 부분 17㎡ 위에는 원고 소유의 창고 및 화장실이 건축되어 있으며, 원고는 현재 이 사건 제1 토지 및 이 사건 제2 토지 중 별지 도면 표시 8, 9, 10, 11, 40, 41, 36, 35, 25, 28, 27, 8의 각 점을 차례로 연결한 선내 193㎡[별지 도면 표시 ㈀, ㈁, ㈂ 부분]를 위 각 건물을 위한 대지로 점유사용하고 있다

(2) Each of the above buildings (hereinafter referred to as “instant building”; the instant land owned by the Plaintiff and the instant land No. 193 square meters, among the instant land No. 2, shall be deemed as “instant site”;

On the other hand, the land No. 2 on the registry is the site.
