For the reasons indicated in its holding, the lower court upheld the first instance judgment that acquitted the primary charges, on the grounds that there is no proof of a crime among the facts charged in the instant case and all the facts charged in the instant case, and acquitted the Defendant on the grounds of the supplementary charges added by the lower court.

Examining the record, the above determination by the court below is justifiable.

There is no error of exceeding the bounds of free evaluation of evidence in violation of logical and empirical rules, or of misapprehending the legal principles on deception and attack in fraud.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
