A. As of April 22, 2015, as between Defendant, Asia Trust Co., Ltd. and Daewoo Construction, the sales contract was concluded that the Defendant purchased the instant apartment from the said company as the total supply price of KRW 375 million (the first down payment of KRW 375 million, the second down payment of KRW 375 million, the intermediate payment of KRW 375 million, the remainder payment of KRW 75 million, and the remainder of KRW 75 million, each over six times).

B. As of April 22, 2015, the Plaintiff and the Defendant drafted a sales contract stating that “the Plaintiff shall purchase the instant apartment from the Defendant the purchase price of KRW 52.7 million (the purchase price of KRW 37.5 million, the balcony expansion amount of KRW 1.2 million, the premium of KRW 1.4 million, and the remaining purchase price of KRW 37.5 million and the intermediate payment loan of KRW 37.5 million shall be succeeded to by the Plaintiff” (hereinafter “instant sales contract”) and “the Defendant shall receive KRW 52.7 million as the purchase price of the instant apartment” (hereinafter “the instant receipt”).

2. The parties' assertion

A.
