A defendant shall be punished by imprisonment for two years.
Punishment of the crime
From June 24, 2013 to December 9, 2013, the Defendant: (a) opened and operated “M Council member” under the name of “M Council member,” a corporate association, and was investigated into a suspected violation of the Medical Service Act on November 6, 2013; and (b) changed the name of “M Council member,” which was between the salary class on December 9, 2013, into the name of “M Council member,” and was subject to the investigation on November 6, 2013.
After that, on December 24, 2013, the Defendant obtained authorization from Gwangju Metropolitan City to establish a legal entity that is AU Medical Consumer Life Cooperatives (hereinafter “AU Medical Life Cooperatives”), and completed a report re-informing the founders of “M Council members” into AU Medical Life Cooperatives on February 17, 2014. On July 30, 2014, the Defendant filed a report by changing the name of “M Council members” to “AV Council members.”
However, in fact, AU Medical Collaboration was established formally by the defendant to continue to operate the "M Council member" because most of its union members are not aware of the fact that it was admitted to the union member or there was no contribution made by the defendant. The defendant paid part of the union members' contributions on behalf of the defendant, and some of its officers are composed of the defendant's family members and branch members.
1. Violation of the Medical Service Act;
A. On February 17, 2014, the Defendant: (a) obtained authorization to establish a AU Medical Life Collaboration in the foregoing “M Council member” (hereinafter “AV Council member”); and (b) completed a report to change the founder of “M Council member” into a AU Medical Life Collaboration.
In addition, a medical doctor, two nurses, and physical clinics are employed and equipped with a medical treatment room, a hospital, a hospital, a physical treatment room, etc.
Accordingly, the Defendant, who is not a doctor, established a medical institution.
(b) Any person shall be a medical institution or a medical service institution for profit, such as exempting or discounting the individual's share under the National Health Insurance Act or the Medical Care Benefits Act, providing money, goods, etc., or providing transportation convenience to many and unspecified persons;
