마약류관리에관한법률위반(향정)
A defendant shall be punished by imprisonment for not less than one year and six months.
One injection (No. 1), one vinyl (No. 2), one vinyl (No. 2), which has been seized.
Punishment of the crime
Despite the fact that the Defendant is not a handler of narcotics, the Defendant handled Mepter (one philopon; hereinafter “philopon”) who is a local mental medicine as follows.
1. From October 2017 to December 12, 2017, the Defendant: (a) 3,50,000 won in part of the price from K to K to arrange the purchase of the opopon at the street in front of the restaurant located in Gangseo-gu Seoul Metropolitan Government H “I”; and (b) delivered a opon package containing approximately five five g of the opon; (c) sold the opon by means of receiving the remainder of KRW 4,000,000 from the above K; and (d) sold approximately 30,50,000 of the price of the opon to the above “J, etc.” through the referral of K for six times in total, as indicated in the attached list of crimes, by December 12, 2017.
2. On December 2, 2017, the Defendant: (a) around 22:00, the Defendant received philophones, in front of “M cafeteria” located in Gangseo-gu Seoul Metropolitan Government L, he received approximately 0.3g of philophones from the said K without compensation.
3. Around December 12, 2017, the Defendant administered a philophone in a single-use injection machine with approximately 0.03g of philophone in Gangseo-gu Seoul Metropolitan Government Officetel 402 on a non-fluorial fluoron, and used it as a raw water, and then administered it in a way of injecting it into the arms.
Despite the fact that the Defendant is not a handler of narcotics, “2018 Highest 2893” dealt with philophones as follows:
1. On January 2, 2016, at around 01:00, the Defendant sold a vinyl of KRW 1.3 million from P on the street in front of “O Park” located in Gangseo-gu Seoul Metropolitan Government N, and then sold a vinyl of KRW 20,000,000 from P, which was about KRW 20,000.
2. On August 2016, the Defendant received 21:00 from the street room in front of the restaurant located in Qu in Gangseo-gu Seoul Metropolitan Government, and from S without compensation, the Defendant received 0.4g of the transparent vinyl paper containing 0.4g of the penphone.
3. On January 9, 2017, the Defendant: (a) around 15:00, in front of the “U hospital” located in Yangcheon-gu Seoul Metropolitan Government T, to V.
