The prosecution of this case is dismissed.
1. On October 4, 2013, at least 01:40 on October 4, 2013, the Defendant: (a) committed assault on the victim’s left face one time with the victim’s right hand-on and one time with his amblock in the right hand-on, on the ground that the Defendant obstructed the passage of the victim E (the age of 38) located on the part of the public notice board.
2. This part of the facts charged is a crime falling under Article 260(1) of the Criminal Act and cannot be prosecuted against the victim’s explicit intent pursuant to Article 260(3) of the Criminal Act. Since an agreement was submitted to the effect that the above victim does not wish to punish the defendant around January 27, 2014, which was after the prosecution of this case, the prosecution of this case is dismissed pursuant to Article 327 subparag. 6 of the Criminal Procedure Act.
