The prosecution of this case is dismissed.
1. Around 02:00 on April 25, 2016, the Defendant: (a) was the victim B (the age of 54) who first met in the street street of Gangdong-gu Seoul Metropolitan Government, and was in the end of the dispute, and was fluencing the victim’s neck by selling, and pushed the victim.
Accordingly, the Defendant committed assault against the victim as above.
2. The above facts charged constitute Article 260 (1) of the Criminal Act and cannot be prosecuted against the victim's express intent under Article 260 (3) of the Criminal Act. Since it is acknowledged that the victim expressed his/her intent not to prosecute the defendant after the prosecution, the prosecution of this case is dismissed in accordance with Article 327 (6) of the Criminal Procedure Act.
