A defendant shall be punished by imprisonment for not less than two months.
However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.
Punishment of the crime
The defendant is a person who lacks the ability to discern things or make decisions due to the on-site illness.

1. On April 15, 2020, the Defendant: (a) 03:00 on April 15, 2020, committed as if he were to pay taxi charges on the front side of the C pharmacy located in Busan Jung-gu, Busan, while having weak ability to discern things or make decisions; and (b) boarded in E-si operated by the victim D.
However, the defendant did not have any intention or ability to pay the taxi fee from the beginning because there was no means to pay the taxi fee at the time.
The Defendant, by deceiving the victim as such, had the victim operate the taxi fee of KRW 195,00,00, via the Haban-Gun Office located in the Haban-gun, Chungcheongnam-gu, Busan, to its neighboring residence, around 05:30 on the same day, and did not pay the victim the taxi fee of KRW 195,00.
Accordingly, the defendant, by deceiving the victim, acquired the same amount of property benefits.
2. On April 23, 2020, the Defendant was driving as if he were to pay the taxi fee on the front of the repair shooting distance in Busan Jung-gu, Busan, while driving as if he had the ability to discern things or make decisions. On April 23, 2020, the Defendant was boarding H-si operated by the victim G.
However, the defendant did not have any intention or ability to pay the taxi fee from the beginning because there was no means to pay the taxi fee at the time.
As such, the Defendant, by deceiving the victim, had the victim operate the taxi at around 10:36 April 24, 202 through the sea of the time when he was in the Seocho-gu, Busan, to the front line of the Bupyeong-gu, Busan, but did not pay the taxi fee equivalent to KRW 447,180.
Accordingly, the defendant, by deceiving the victim, acquired the same amount of property benefits.
