Punishment of the crime
On November 2, 2010, the Defendant was sentenced to a fine of KRW 5 million for a violation of the Road Traffic Act, etc. in the Gwangju District Court’s net support on November 2, 2010, and a fine of KRW 5 million on September 17, 2012, by the same court on September 17, 2012, respectively.
【Criminal Facts】
On July 30, 2013, the Defendant, without purchasing mandatory insurance around 04:10 on July 30, 2013, operated a motor vehicle with blood alcohol concentration of 0.160% without a motor vehicle driver’s license, and proceeded to the red flag and ice restaurant in front of the instant motor vehicle at the entrance of the Seopo-si in Seopopopo-si, Seopo-si, with a view to an occupational negligence that neglected to repair the front road, and caused the Defendant to damage each of the above te-owned parts of the victim E-owned car and the front portion of the passenger cargo vehicle owned by the victim C to reach KRW 728,00,00 in total of the repair cost of the said passenger vehicle.
The Defendant is a person engaged in driving a Hexton car who was not covered by mandatory insurance from March 11, 2014.
On March 11, 2014, at around 05:00, the Defendant, without a driver’s license, driven the said car under the influence of 0.226% of alcohol concentration without a driver’s license, and proceeded with a road in front of the Daecheon-si Municipal Ordinance, which is located in the 13th Gicheon-si, Seocheon apartment room located in the 13th, such as the Municipal Ordinance of Sincheon-si.
In such cases, despite the fact that the driver of a motor vehicle has a duty of care to prevent traffic accidents in advance by living well on the right side and safely, the motor vehicle driver has been negligent in doing so and the motor vehicle driver has a duty of care to prevent the traffic accidents.
