According to the evidence duly adopted and examined by the court below, the defendant's act and the injury of the victim can be acknowledged as the fact that the defendant was tightly damaged by the victim's scambling towards the water level as stated in the judgment of the court below. Accordingly, according to the above facts of recognition, the causal relation between the defendant's act and the injury of the victim is sufficiently recognized. Thus, the above assertion by the defendant is without merit.

3. If so, the defendant's appeal is without merit, and it is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act. It is so decided as per Disposition.
