1. The instant lawsuit shall be dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
1. Details of the disposition;
(a) Approval of the housing construction project plan and the modification of the project undertaker; 1) A stock company of the same housing (hereinafter referred to as “family housing”)
A) On January 29, 1997, the Defendant constructed a housing construction project (hereinafter “instant project”) with the content of constructing a collective housing (multi-family housing) with 15 7 dong-dong 1440 households on the ground of the aggregate of 54,369 square meters of land A and B in ASEAN-si and ASEAN-si, Asan-si (hereinafter “instant project”).
2) Each of the above project sites and apartments is subject to the approval of the project plan for the project (hereinafter referred to as the “instant project site” and the “instant apartment.”
(2) On May 10, 201, when the project was being carried out, the project was carried out in default on February 16, 2001, and accordingly, the project was suspended at a rate of 40%. (2) On May 10, 2001, the dongdong Comprehensive Construction Co., Ltd. 3) On December 18, 2002, Donggin General Construction suspended the said construction at a progress of 70% due to a lack of funds, and on April 18, 2003, C, the creditor, upon receipt of a decision of compulsory commencement of construction on April 18, 2003, completed the registration of ownership preservation in the name of Donggin General Construction in the name of Donggin General Construction. 4) On April 18, 2003, the plaintiff acquired the instant project site, apartment and business rights from Donggin General Construction, and obtained a modified approval for change from the defendant on September 9, 2003 to the plaintiff, and completed the registration of ownership transfer in the name of the plaintiff with respect to the instant apartment on December 30, 2003.
5 The plaintiff borrowed money from D to acquire the apartment of this case, and thereafter, to D on April 18, 2003.
