1. The Defendant’s KRW 22,354,015 with respect to the Plaintiff and KRW 5% per annum from May 8, 2012 to January 19, 2017.
1. Occurrence of liability for damages;
A. At around 01:40 on May 8, 2012, B, driving a taxi for C business use (the conclusion of a mutual aid agreement with the Defendant), and collisioned the part of the driver’s driver’s seat of the Plaintiff’s FF car driving seat with the two-lanes while changing the course from the glockter to the glockside of Ulsan-gu, Ulsan-gu to the glock zone.
Due to its shock, the Plaintiff’s car was driving on the right side of the building and shocked the building, and the Plaintiff suffered injuries, such as the upper half alley, etc.
(hereinafter referred to as “instant accident”). [Grounds for recognition] There is no dispute, entry in Gap’s evidence Nos. 1 through 3, and the purport of the whole pleadings.
B. The defendant shall be liable for damages sustained by the plaintiff due to the negligence of violation of B's duty of safe driving as the insurer B.
2. Except as otherwise stated below within the scope of damages, it shall be excluded as stated in the separate sheet of calculation of damages, and it shall be rejected that the parties’ arguments are not separately explained.
The amount of damages shall be discarded less than the won and less than the month of the last month, and the amount shall be calculated according to the reduction rate which deducts the interim interest at the rate of 5/12 percent per month at the time of the accident.
(1) On the 31st day (from May 9, 2012 to October 24, 2013, to November 7, 2011 of the same year) during the period of hospitalization (from May 9, 2012 to the date of the instant accident), the rate of loss of labor capacity 100% between the date following the instant accident and the date of June 8, 2012) the latter disability and the rate of loss of labor capacity 30% between the head of the G Counseling Center team, the monthly income 1,619,217 won 2): calculation of the amount of damages in attached Form 31 (from October 24, 2013 to the date of the instant accident).
(b) Expenses for medical treatment of 4,925,280 won;
(c) future treatment costs of KRW 2,580,00 (in the case of hospitalization, only one day);
