Punishment of the crime
The defendant is the pastor of the C church located in Seo-gu, Busan.
In order to prevent infectious diseases, the Minister of Health and Welfare, the Mayor/Do Governor, or the head of a Si/Gun/Gu shall take measures to restrict or prohibit performances, assemblies, religious rites, or other large gatherings of people, and no person shall violate such measures.
On August 20, 2020, the Busan Metropolitan City Mayor: from around 00:00 on August 21, 2020 to around 24:00 on August 21, 2020, issued a collective restriction order that allows only non-face-to-face-to-face-to-face-to-face-to-face-to-face-to-face-to-face-face-to-face-face-to-face-face-to-face-face-to-face-face-face-to-face-face-on-face-on-face-on-face-on-face-on-face-on-face-on-on-face-on-face-on-face-on-on-face (hereinafter referred to as “the aggregate restriction order”), extended the enforcement period until September 24, 2020 to September 24, 200; and extended the enforcement period again on September 18, 2020.
Nevertheless, the Defendant:
1. On August 30, 2020, around 10:00, approximately 554 believerss and hosts the worship in the distribution of the worship of the above church;
2. On September 6, 2020, at around 10:00, approximately 522 believerss are collected from the distribution of the worship of the above church and hosts the worship;
3. On September 20, 2020, around 10:00, approximately 522 believerss are collected from the distribution of worship to the above church, and host the worship;
4. On September 27, 2020, around 10:00, approximately 500 believerss and hosts the worship in the distribution of the worship of the above church;
5. On October 4, 2020, around 10:00, approximately 700 believerss are collected from the distribution of worship to the above church and hosts the worship;
6. On October 11, 2020, around 10:00, approximately 700 believers were gathered in the distribution of the worship of the above church and hosted the worship, thereby violating the order of collective restriction by the Busan Metropolitan City Mayor.
