However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

From September 10, 2014 to October 8, 2016, the Defendant served as a business and sales employee at the Incheon Branch of D Co., Ltd. operated by the victim C in Bupyeong-gu Incheon, Bupyeong-gu, Incheon, and sold beauty art supplies to the Incheon Youth Center and collected the price.

1. Occupational embezzlement;

A. On June 21, 2016, the Defendant sold beauty appliances to E operating beauty parlors at the above Incheon branch office, and collected 200,000 won from E to keep the proceeds in custody for the victim’s business.

At that time, the Defendant submitted to the company a “E” on the upper end of the sales slip as if he had been settled by E using a duplicate sales slip after having received payment by credit card from another customer, and then embezzled KRW 200,000,000 which was actually received by the Defendant for personal purposes.

Defendant embezzled KRW 200,00,000 from that time to September 30, 2016, including embezzlement of KRW 200,000 as above, and embezzled KRW 6,482,00 through 23 times, as shown in the first list of crimes in the attached Table 1.

B. On June 24, 2016, the Defendant sold 12 with a 144,000 U.S. goods to F, and collected 144,000 won from the foregoing Incheon branch office, and was in the custody of the victim for business purposes. Around that time, the Defendant embezzled the said money for personal purposes without depositing it in the company.

In addition to embezzlement of KRW 144,00 as above, the Defendant embezzled KRW 17,85,000, which was collected from customers over 258 times from October 15, 2015 to October 6, 2016, as shown in attached Table 2 of the Crimes List 2, as well as embezzlement of KRW 17,85,00 for personal purposes.

On April 29, 2016, the Defendant entered 31,000 won in the foregoing Incheon branch office to release 5 fexcherbs to the factory site, and sold fexchers to G during the course of sale, even though there was no fact of sale in G during the course of business storage for the victim.
