1. The defendant shall pay 106,453,532 won to the plaintiff and 12% per annum from March 14, 2020 to the day of complete payment.
Although the Plaintiff completed the above construction by being awarded a subcontract for various repair works and automation construction works within the Culsan Factory owned by the Defendant from around November 2019, the fact that the Plaintiff was not paid the construction cost of KRW 201,130,000 (value-added tax separate) as of November 26, 2019 can be acknowledged in full view of the purport of the entire pleadings in each of the evidence Nos. 1, 2, and 3, and the Plaintiff was paid KRW 94,676,468 out of the above construction cost by the Defendant Company C, the ordering agent, as of November 26, 2019.
According to the above facts, the defendant is obligated to pay to the plaintiff the remaining construction cost of KRW 106,453,532 (201,130,000 - KRW 94,676,468) and damages for delay calculated at the rate of 12% per annum under the Act on Special Cases Concerning Expedition, etc. of Legal Proceedings from March 14, 2020 to the date of full payment, as the plaintiff seeks after the due date.
Therefore, the plaintiff's claim is accepted on the ground of the reasons.
