1. Defendant A shall be punished by imprisonment with prison labor for one year.
However, the above sentence shall be executed for a period of two years from the date this judgment becomes final and conclusive.
Punishment of the crime
"2016 Highest 902"- Defendant A dealt with narcotics, etc. although he/she is not a narcotics handler, Defendant A dealt with them as follows:
1. On December 23, 2014, the Defendant administered narcotics, etc. by inserting approximately 0.05g of Mesofta (i.e., one philopon; hereinafter “philopon”) into a single-use injection machine and dilution them into arms, in a way that it is difficult to identify the trade name located in the Gansi-si Area around 23:00, the Defendant administered narcotics, etc. by inserting approximately 0.05g of Melopon into a single-use injection machine, which is a local mental medicine.
2. On December 24, 2014, at around 16:00, the Defendant administered narcotics, etc. in a way of inserting E hotel 208 heading in Suwon-si D, and mopon 0.05g heading in a single-use injection machine, mopon 0.05g heading into a single-use injection machine, and dilution them into arms.
3. The Defendant: (a) purchased philophones from F and conspiredd with B and G to administer them; and (b) purchased philophones by communicating F on December 27, 2014 to purchase philophones.
And G remitted 800,000 won of philopon to a post office account designated by F on the same day, and the Defendant and B purchased and sold narcotics, etc. using 2 a philopon 1.4g from F from around 18:00 on the same day to 18:00 on the same day.
Accordingly, the Defendant sold narcotics in collusion with B and G.
4. On December 28, 2014, the Defendant administered narcotics, etc. in a way of inserting E hotel 208 heading in Suwon-si, Suwon-si, E in D, and 0.05g philopon into a single-use injection machine, dilution it into a single-use injection machine, and injection into a arms.
5. On December 29, 2014, at around 01:00, the Defendant administered narcotics, etc. in a way of inserting E hotel 208 heading in Suwon-si D, and mopon 0.05g heading in a single-use injection machine, mopon 0.05g heading into a single-use injection machine, and dilution them into arms.
On March 3, 2016, Defendants B were detained for a violation of the Narcotics Control Act (fence) at the Busan District Court on March 3, 2016, and on April 7, 2016, Defendant B was sentenced to imprisonment with prison labor for not less than two years and the said judgment became final and conclusive on April 15, 2016.
