Examining the record, we affirm the court below's finding the defendant not guilty of the facts charged in this case on the grounds that there is no proof of crime.

In so doing, contrary to the allegations in the grounds of appeal, there is no error of misapprehension of facts in violation of logical and empirical rules or by misapprehending the legal principles on “the principle of trust”.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
