Defendant

A is the representative director of the ship and crew management business in the Jung-gu, Busan, and the director of the company, the director of the company, and the defendant B are the vice-director of the company, respectively.

The Defendants established a separate company in Indonesia and independently operated the company, and the fund management in the process was not delayed. On July 29, 2014, the Defendants decided that all the shares of the above company owned by the Defendants belong to the above company through a resolution of a temporary general meeting of shareholders of the above company, and that the Defendants did not participate in the operation of prior owners, who are customers of the above company.

Nevertheless, on July 30, 2014, the Defendants conspired to conduct the business registration of H (representative) Ship Management Business Operator H (Defendant C) and opened an account in the name of H (H) at the Korea Standards Agency (K). On the same day, the Defendants sent out the e-mail to the Defendant’s office to the person in charge of each vessel owner, who is a business partner, as the title “G department for cooperation in the separation of labor relations”, and “the crew member of each vessel owner, who is a business partner, is to be newly established through the separation of the main company and the department, and is scheduled to newly enter into a contract for all seafarers and vessel management under the current contract, and to send the attached business registration certificate and the corporate account to be managed. At present, G (State) currently sent the e-mail that is without relation to the Japanese vessel owner, and then sent the e-mail that is to be in charge of the management of the vessel owner’s own national territory and the new column for the management of the vessel owner’s national territory.”

The head of the Tong and the business registration certificate shall be attached.
