A defendant shall be punished by imprisonment for two years.
Punishment of the crime
[criminal record] On January 26, 2010, the Defendant was sentenced to eight months of imprisonment for larceny at the Busan District Court. On August 4, 2011, the Defendant was sentenced to six months of imprisonment for attempted larceny at the Daegu District Court’s Ansan Branch, and on September 20, 201, was sentenced to one year and two months of imprisonment for larceny, etc. at the Daejeon District Court’s Incheon District Court’s Incheon Branch on January 21, 2015; on November 22, 2016, the Defendant was sentenced to ten months of imprisonment for special larceny; on November 22, 2016, one year and six months of imprisonment for violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Larceny) at the Seoul District Court’s Busan District Court’s Busan Branch on May 25, 2017, and completed the execution of the sentence on October 25, 2018.
[2019 order 2910] Defendant was sentenced to imprisonment three times or more with prison labor due to larceny, etc., and committing larceny again during the period of repeated crime.
1. Around 00:02 on June 8, 2019, the Defendant: (a) opened a driver’s seat, which is the victim C, parked at the front parking lot of the Dong-gu, Ansan-si; (b) opened a driver’s seat of the victim C, who was parked therein, in his/her hand, and stolen the vehicle with one set of 1,70,000 the market price on the rear seat of the driver’s seat, which is equivalent to KRW 1,70,000.
2. On June 8, 2019, the Defendant: (a) opened a door in front of the unit E-gu, Ansan-si, the victim F, who was parked there, in his/her own possession; (b) opened a door in front of the unit E-gu, Ansan-si; and (c) stolen the Defendant with KRW 300,000,00 in cash located on the part of the market price of the container 300,000.
3. On July 11, 2019, the Defendant: (a) opened a door of a driver’s seat which was parked in the Hacheon-si H parking lot, the victim I owned, in his/her hand, and stolen KRW 300,000 in cash, and KRW 50,00 in cash in the instrument board, which was parked in the Hacheon-si H parking lot.
4. At around 22:00 on July 18, 2019, the Defendant franchiseed the victim L, who was parked therein at the Dacheon-si parking lot.
