A defendant shall be punished by imprisonment for a period of five months.

Reasons

Punishment of the crime

1. Forgery of private documents and the display of private documents;

A. On April 1, 2016, the Defendant: (a) around April 1, 2016, the Defendant entered “F” in the column in the location of “Real Estate Lease Contract” in the Ulsan-gu, Ulsan-gu, Seoul-do; (b) “Mon 5,00,000,” “Mon 350,000,” and “F” in the column in the name of the lessor’s name; and (c) carried out a false real estate lease agreement with the lessee G as if it was duly concluded, with the intent to exercise the said agreement.

As a result, the Defendant forged one copy of the real estate lease contract in the name of F, which is a private document on rights and obligations, and exercised the forged document.

B. On June 14, 2016, the Defendant committed the crime of June 14, 2016: (a) indicated in the column for the location of “Real Estate Lease Contract” as “No. H of buildings D in Ulsan Metropolitan City,” “No. 20,000,000,” “No. 5,000,000 won in the deposit column; (b) stated in the rent column as “5,00,000 won”; (c) stamped on the lessor’s name column as “F”; and (d) arbitrarily stamped on the buyer’s name; and (e) uses a forged real estate lease contract to the lessee I as if it was duly concluded.

As a result, the Defendant forged one copy of the real estate lease contract in the name of F, which is a private document on rights and obligations, and exercised the forged document.

2. Fraud;

A. The Defendant committed the crime in April 1, 2016 under Article 1(a).

In the time, at the time, at the time, and at the place specified in paragraph (1), when concluding a lease contract with the victim G for the building E, the victim made a false statement stating that “The victim will deliver the deposit amount of KRW 5 million, monthly rent of KRW 350,000,000 to the lessor on the prime page, and KRW 5 million.”

However, the defendant did not have the right to enter into a lease contract with the victim on behalf of the lessor.
