The appeal of this case is dismissed.
Costs of appeal shall be borne by the respondent.
1. Purport of request;
On June 28, 2013, the respondent's disposition of restricting participation in competitive tendering process open only to small and medium enterprises which had been conducted by applicants on June 28, 2013 is suspended until the Seoul Administrative Court 2013Guhap23546 ruled that such disposition is revoked.
2. Purport of appeal;
The decision of the first instance shall be revoked. The applicant's application shall be dismissed.
According to the records of this case, it is recognized that there is an urgent need for the respondent to immediately suspend the execution in order to prevent irrecoverable damage to the applicant due to a disposition made against the applicant, and there is no other evidence to deem that the suspension of execution may have a significant impact on public welfare due to the suspension of execution. Accordingly, the decision of the first instance court is justifiable with this conclusion, and it is so decided as per Disposition by the respondent.
