A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

1. Fraud;
A. On the Internet homepage on October 2016, the Defendant: (a) posted a notice on the Internet (Internet shopping mall) stating that “In order to increase sales performance by purchasing a small amount of money on the Internet shopping mall; and (b) doing so, people interested who throw butt buttts butt money may contact with each other; and (c) intended to receive money from the victims introduced through this page by allowing them to settle a mobile phone small amount of money.
On October 18, 2016, the Defendant’s residence in Songpa-gu Seoul apartment C apartment 302 Dong, which is located in Songpa-gu Seoul Metropolitan Government, should raise the result of sales to the victim D in order to have the goods posted on the Internet cane page.
B. He/she made a false statement that he/she would purchase on a discount basis, but pay 10% of the settlement amount as commission in lieu of the cancellation of the settlement immediately if he/she would make the settlement with the mobile phone of the party.
However, the defendant had no intention or ability to cancel the settlement of small amount with the cell phone of the victim and pay fees.
The defendant deceiving the victim as above, received information related to the settlement of the victim's mobile phone amount on two occasions on the same day from the victim, and made it possible to cancel it immediately and pay 50,000 won to the victim in return for the cancellation and trust of the victim, and made the victim pay the victim a small amount of 50,000 won with the victim's mobile phone number, thereby allowing the victim to bear it, and acquiring the equivalent pecuniary profit.
In addition, the Defendant, from that time until February 4, 2017, had five victims settle the total sum of KRW 2,898,040 over 11 times, such as the list of crimes in attached Form 1 (1).
B. On November 27, 2016, the Internet fraud Defendant was at the Defendant’s residence located in Songpa-gu Seoul apartment house C, Songpa-gu, Seoul, and at the Defendant’s residence.
