1. The Defendant’s determination of the amount of litigation costs (2013AA2503) against the Plaintiff on December 4, 2013 by the Seoul Administrative Court.
In addition to the overall purport of the pleadings, evidence Nos. 3 and 5 were examined as follows: ① (i) a final decision on Oct. 4, 2013, stating that with respect to the case of confirmation of the amount of litigation costs between the Plaintiff and the Defendant, the Plaintiff is KRW 4,514,018, the amount of litigation costs to be repaid to the Defendant (hereinafter “instant decision”) was rendered (a final decision on Oct. 4, 2013, which determined that the amount of litigation costs to be repaid to the Defendant was KRW 4,514,018 (hereinafter “instant decision”), and (ii) the Plaintiff paid the Defendant KRW 4,514,018.
According to the above facts, since the defendant was reimbursed KRW 4,514,018 of the costs of lawsuit confirmed by the decision of this case, the execution force of the decision of this case, which is the executive title, was extinguished.
Therefore, the defendant's compulsory execution based on the decision of this case against the plaintiff is rejected.
