가. 원고는 2017. 11. 30. 피고와 사이에 다인 로얄팰리스 목감6차 신축공사 중 조경공사에 관하여 당초 계약금액 60,500,000원, 준공일 2017. 8. 31.이던 계약을 계약금액 95,700,000원, 준공일 2017. 8. 30.로 변경하는 하도급변경계약을 체결하였고, 원고는 위 계약에 따른 조경공사를 완료하였다.

B. By April 26, 2018, the Defendant paid the Plaintiff KRW 54,280,050 in total as the progress payment for the landscaping construction.

According to the above facts of recognition, the Defendant is obligated to pay the Plaintiff the construction cost of KRW 41,419,950 (i.e., KRW 95,70,000 - KRW 54,280,050) and damages for delay calculated at the rate of 6% per annum under the Commercial Act from February 2, 2018 to the date of full payment, which is the day following the delivery of a copy of the complaint of this case.

3. In conclusion, the plaintiff's claim of this case is reasonable, and it is so decided as per Disposition.
