From around 2011, the Defendant is the representative of occupants of Suwon-gu Seoul Metropolitan Government C Apartment (hereinafter “instant apartment”), and D is the head of the management office of the instant apartment.

Around February 7, 2012, the Defendant submitted a written application for support for multi-family housing, “project plan,” and “a estimate” to request a person in charge of the foregoing construction work to grant the victim’s repair of housing and the name in charge of the construction of housing construction of the Suwon-si, Suwon-si, to KRW 120,000,000 in total the construction cost. On November 13, 2012, the Defendant filed an application for support with the purport that the Defendant would request the person in charge of the construction of housing and the construction of housing for viewing, including the E Park Creation Corporation, to grant the subsidy to KRW 121,00,00 in total.

However, the E Park Creation Corporation, in addition to the above F Construction Work implemented by the Defendant and D, was constructed as a defect repair work for 10,000 years after the apartment construction in the Eastern Construction. Thus, the Defendant and D did not have been related to the F Construction Work executed by the Defendant and D. Although the actual construction cost used at the F Construction cost is less than 90,900,000 won, the cost of the E Park Construction cost was added to KRW 30,100,000 at the F Construction cost, and the Defendant and D demanded the victim to provide subsidies.

On November 20, 2012, the Defendant, in collusion with D, by deceiving the reception of victims as such, received not only KRW 28 million from the victim as a subsidy but also KRW 45 million from the account under the name of the council of occupants' representatives, such as receiving more than KRW 17 million from the account under the name of the council of occupants' representatives on the pretext of additional subsidies.
