Basic Facts
A foundation B is a non-profit corporation established on April 10, 1996 for the purpose of promoting the proper understanding of the international community and the promotion of international friendship through international exchange and cooperation projects of broadcasting, and operates E-broadcastings, such as C and D, to enhance national image and promote the understanding of international society.
(hereinafter referred to as the “C”). The F served as the head of the Broadcasting Headquarters Formation Team of C around 2015, and is currently in service as the head of the management headquarters global network team. On the other hand, G was in service as C’s representative from December 2014 to February 2016.
The Defendant is a newspaper enterpriser and an online newspaper enterpriser who is established for the purpose of publishing and selling newspapers, Internet media business, etc., and published a general daily newspaper ‘Internet tendency newspaper’ (website htp://www.kh.co.) electronically published online newspaper.
The plaintiff (representative director H) is a company established on April 14, 200 for the purpose of the business of producing broadcasting programs.
On February 27, 2015, the Plaintiff, such as the use of “I” PP 1 production, holding, and JM PP 1, changed the name of the program after C, “I,” which is a cultural free materials program (X 24, each 60 minutes), announced by C, to K.
(I) On March 20, 2015, the Plaintiff filed an application for participation in the production of the program of this case (hereinafter referred to as “instant program”) with C to obtain the highest points (92.00 points) from among the 16 bidders, and subsequently entered into a contract on the production of the program of this case with C, and produced and supplied the instant program Season 1 (Sin Pon 1) to C.
The instant program, which was aired from July 2015 to December 2015, is a variety of information, society, culture, survey, including Korean culture and history.
