The plaintiff's lawsuit against the defendant B is dismissed.
Defendant C Company 106,624,206 won and 106 won to the Plaintiff.
1. Facts of recognition;
A. In order to manage a building built for the purpose of the management of a building A (hereinafter “the instant condominium”) with the second underground floor, the tenth underground floor, the tenth floor above the ground, and a building constructed for the purpose of a business facility, the Plaintiff’s status as a party to the dispute is omitted from E heading (3.49m2) in a written appraisal written by 124 households for the purpose of the management.
The autonomous management body consisting of the sectional owners, and Defendant C Co., Ltd. (hereinafter “Defendant C”) is the executor and seller of the instant condominium building, and Defendant B Co., Ltd (hereinafter “Defendant B”) is the starting construction of the instant condominium building by receiving a supply from Defendant C.
B. 1) The instant aggregate building was approved for use on February 13, 2017, and the sectional owners received delivery of the instant aggregate building. From around that time, there were defects such as rupture and water leakage in the section for common use and the section for exclusive use by not constructing a part to be constructed in accordance with the design drawings (approval drawings) in the process of construction of the instant aggregate building, or by falsely constructing the instant aggregate building in a manner different from design drawings, and thereby constructing the instant aggregate building differently from design drawings. As a result, the sectional owners and the Plaintiff requested repair of defects on several occasions. However, according to the results of the appraisal and supplementary commission for the appraiser F of the instant aggregate building, the number of co-owners and the Plaintiff still requested repair of defects in the instant aggregate building from 1-5 underground parking lot floor, rupture, rupture of 10-8 underground parking lot, and the cost of repairing 150-15,515-15,5500,000 annually.
There are the same defects as the entries in each list of defects in the attached section for exclusive use, and the repair cost shall be the following separate calculation table of the total cost of repair.
