Punishment of the crime
The defendant is an employer who operates a building business by employing daily workers at a new construction site of an individual house located in Chungcheongnam-gun, Chungcheongnam-gun, Chungcheongnam-gun, and operating a building business in a new construction site of an individual house located in Chungcheongnam-gun.
When a worker dies or retires, the employer shall pay the wages, compensations, and other money or valuables within 14 days after the cause for such payment occurred.
Provided, That in special circumstances, the date may be extended by an agreement between the parties.
1. The Defendant did not pay the total of KRW 1,825,00,00 for five workers, including F, G, and H’s wage of KRW 425,00,00, each wage of KRW 275,00 from September 1, 2015 to September 3, 2015, at the site of new private housing construction works in Chungcheongnam-gun, Chungcheongnam-gun, within 14 days from the date of retirement, which is the date on which the grounds for payment occurred, without agreement between the parties on the extension of the payment period.
2. The Defendant did not pay 350,000 won wage of L, 350,000 won, M’s wage 350,000 won, N’s wage 450,000 won, N’s wage 450,000 won, wage of 1.4 million won on January 1, 2016, wage of 1.4 million won on February 1, 206, wage of 1.5 million won on March 2016, wage of 1.5 million won on March 25, 2016, wage of 1.5 million won on April 1, 2016, wage of 100,000 won on October 28, 2015, wage of 1.5 million won on May 16, 2016, wage of 400,0000 won on March 16, 2016, wage of 6.4 million won on the date of retirement from office.
