Punishment of the crime
The Defendant is a person engaging in driving vehicles B.
On November 18:27, 2019, the Defendant followed the intersection in front of the sand market history distance in the Nam-gu Incheon Metropolitan City, Nam-gu, Incheon to the small long-term distance from the sand village shooting distance.
When intending to drive a motor vehicle into the intersection in which traffic is controlled by signal apparatus, the driver of any motor vehicle shall stop in the intersection (where a stoppage line is marked, referring to the area beyond such stoppage line) due to the situation of the motor vehicle in front of the course in which he/she intends to drive, and where it is likely to impede the traffic of other motor vehicles, he/she shall not drive the intersection, and temporarily stop in front of such crosswalk (where a stoppage line is marked, referring to the stoppage line) so as not to impede the crossing of pedestrians or endanger them.
Nevertheless, the Defendant, even though the crossing was in office, was driving a vehicle to enter the yellow signal to stop on the crosswalk beyond the stop line, resulting in the obstruction of pedestrians or the danger of pedestrians' safety.
Summary of Evidence
1. The Road Traffic Act provides a stop line when a witness C, who made a partial statement at the court, imposes an obligation to prohibit the driver from entering the road into the intersection or temporarily stop the crosswalk in front of the crosswalk depending on the road and vehicle conditions.
This is interpreted as a provision that imposes an obligation to observe the stop line on drivers so that vehicles can pass smoothly and safely cross the road in consideration of the change of traffic conditions and pedestrian conditions of the road.
Examining the CD images of the control film of this case, a crosswalk beyond the stop line at the time when the Defendant’s vehicle signal changes to yellow.
